Terms of Service for Most High Ministries, Inc.

Welcome.
Most High Ministries, Inc. (“we,” “us,” “our”) is a nonprofit organization based in Georgia. We operate an online recovery education platform (the “Platform”) available through our websites(mosthigheducation.com, mosthigheducation.org, mosthighedu.com, mosthighedu.org). These Terms of Service (“Terms”) govern your access to and use of our Platform.
By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, you may not use the Platform.
1. Our Service: Educational, Not Clinical
Our Platform provides educational content, personal reflection tools, and progress tracking related to recovery and personal development. It is not a healthcare service.
- Not Medical Advice: We are not doctors, therapists, or licensed counselors. All content on the Platform is for informational and educational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Because we are not a healthcare provider, laws like HIPAA (health information privacy) or 42 C.F.R. Part 2 (confidentiality of substance use disorder records) do not apply to information you share on the Platform.
- No Crisis Services: Our Platform is not designed for emergency or crisis situations. If you are experiencing a mental health crisis, thoughts of self-harm, or any medical emergency:
- Call or text 988 for the Suicide & Crisis Lifeline.
- Dial 911 or go to your nearest emergency room.
- Contact a licensed healthcare professional immediately.
- No Therapeutic Relationship: Your use of the Platform does not create a doctor-patient, therapist-client, or any other confidential professional relationship.
2. Your Account & Eligibility
- Age Requirement: You must be at least 18 years old to create an account and use the Platform. By using the Platform, you represent that you are at least 18.
- Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to notify us immediately of any unauthorized use.
- Accurate Information: You agree to provide accurate and complete information when creating an account and to update it as necessary.
- Account Termination: We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time via your dashboard. Data deletion practices are outlined in our Privacy Policy.
3. Acceptable Use & Conduct
You agree to use the Platform lawfully and respectfully. You WILL NOT:
- Use the Platform to harm, harass, or threaten others, or post content that is abusive, defamatory, obscene, or discriminatory.
- Impersonate any person or entity.
- Upload, post, or share any content that infringes on someone else’s intellectual property rights or privacy.
- Share another person’s sensitive personal information (e.g., health details, contact info) without their explicit consent.
- Attempt to interfere with, hack, or disrupt the security, integrity, or functionality of the Platform.
- Use automated systems (e.g., bots, scrapers) to access the Platform or extract data.
- Use the Platform for any commercial purpose without our express written permission.
- Use the Platform in any manner that violates any applicable law or regulation.
We reserve the right to remove any content or terminate any account that we determine, at our sole discretion, violates these Terms.
4. Your Content & Privacy
- Private Reflections: Your personal journal entries and private reflections are treated as confidential data. As stated in our Privacy Policy, we do not actively monitor or review this content.
- License to Us: By submitting any content to public or shared areas of the Platform (if such features are offered), you grant us a non-exclusive, royalty-free license to use, display, and distribute that content solely for the purpose of operating and promoting the Platform. This license ends when you delete the content or your account.
- Your Responsibility: You are solely responsible for any content you submit. You affirm that you own or have the necessary rights to any content you post.
- Authorized Third-Party Access: If you use the Platform as part of a program, organization, or court referral, you may choose to authorize an Authorized Program Administrator to access your account information and submitted content. Any such access is granted at your direction and risk. We do not control and are not responsible for how an Authorized Program Administrator reviews, uses, stores, or discloses your information after it has been accessed.
5. Our Intellectual Property
The Platform, including all text, graphics, logos, software, design, and the “look and feel,” is owned by us or our licensors and is protected by copyright and other intellectual property laws.
We grant you a limited, personal, non-transferable, and revocable license to access and use the Platform for your own non-commercial education. You may not copy, modify, distribute, sell, or create derivative works of our content without our prior written permission.
6. Third-Party Links
The Platform may contain links to third-party websites or resources. We provide these for convenience only. We do not endorse and are not responsible for the content, products, or services on these external sites. You access them at your own risk.
7. Disclaimers & Limitation of Liability
- “As Is” Service: The Platform and all content are provided “as is” and “as available” without warranties of any kind, either express or implied. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, secure, or error-free, or that the content is accurate or complete.
- No Outcome Guarantees: We make no guarantees, representations, or warranties regarding the effectiveness, completeness, or suitability of the educational content for your personal situation.
- Limitation of Liability: To the fullest extent permitted by law, Most High Ministries, Inc., its directors, officers, employees, and volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. This includes, but is not limited to, damages for emotional distress, loss of data, or any relapse or other personal outcome you attribute to your use of the Platform.
- Total Liability: Our total liability to you for any claim under these Terms shall not exceed the greater of one hundred U.S. dollars ($100) or the amount you have paid us in the past twelve months. Some jurisdictions do not allow the exclusion or limitation of certain damages; to that extent, these limitations may not apply to you
- Third-Party Access Disclaimer: To the fullest extent permitted by law, Most High Ministries, Inc. is not responsible for any actions, decisions, or consequences arising from access to your information by an Authorized Program Administrator that you have approved. This includes, but is not limited to, how such information is interpreted, used, stored, or disclosed by that third party.
8. Indemnification
You agree to indemnify and hold harmless Most High Ministries, Inc., its affiliates, and each of their respective directors, officers, employees, and volunteers from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; or (c) your violation of any rights of a third party.
9. Changes & Termination
- To the Terms: We may modify these Terms at any time. We will post the updated Terms with a new effective date. Your continued use after changes constitutes acceptance.
- To the Platform: We may change, suspend, or discontinue any aspect of the Platform at any time. We will not be liable to you for any such change, suspension, or discontinuation.
10. Governing Law & Dispute Resolution
These Terms shall be governed by the laws of the State of Georgia, without regard to its conflict of law principles.
- Arbitration Agreement: You and Most High Ministries agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform will be resolved through final and binding arbitration on an individual basis, rather than in court. YOU UNDERSTAND THAT YOU ARE WAIVING YOUR RIGHT TO A TRIAL BY JURY. The arbitration will be administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules. You may choose to have the arbitration conducted by telephone, video conference, or in-person in the county where you live, or another mutually agreed location. The arbitrator shall apply Georgia law.
- No Class Actions: YOU AND MOST HIGH MINISTRIES AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
- Exceptions: Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes or claims within that court’s jurisdiction, and either party may bring a lawsuit in state or federal court in Fulton County, Georgia solely for injunctive relief to stop unauthorized use or abuse of the Platform or intellectual property infringement.
- Opt-Out Right: You have the right to opt out of this arbitration agreement by sending us written notice of your decision within 30 days of first accepting these Terms. If you opt out, any disputes will be resolved in court in accordance with the “Governing Law” provision above
11. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
- No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
- Assignment: We may assign our rights and obligations to an affiliate or in connection with a merger or acquisition.
